Articles of Agreement, made this third day of December A.D. 1875 between the Philadelphia Base Ball Club of the one part, and Charles Mason of the City of Philadelphia of the other part, Witnesseth. that the said parties have covenanted and agreed by these presents do respectively and agree as follows: -
1st, That the said Charles Mason for and in consideration of the premises hereinafter mentioned, shall and will play Base Ball in the City of Philadelphia and at other places as to the said Philadelphia Base Ball Club shall seem meet; and shall not, nor will play or participate in the said game of Base Ball with any organization, club, company or individual other than said Philadelphia Base Ball Club, without first having received the written consent of said Philadelphia Club so to do.
2nd, said Charles Mason shall and will subject himself, conform to and obey all rules, regulations and edicts prescribed from time to time by the said Philadelphia Base Ball Club for the proper management and discipline of said Club and the several members thereof; and he shall and must abstain from all excesses and dissipations which may impair his physical condition, or render him unfit to perform all duties assigned him; and he shall and will participate and take part in every exhibition or game of Base Ball arranged for, and played by the said Philadelphia Base Ball Club; and in the event of his refusal, neglect or inability from any cause, saving sickness or and excuse from the proper officer, to take part and participate in said game or games, he shall incur such penalty as said Philadelphia Base Ball Club shall deem necessary to inflict.
3rd, This agreement shall continue in full force and effect for the period of one year from the third day of December A.D. 1875, but it is expressly understood and agreed by and between the said parties hereto, that the said Philadelphia Base Ball Club reserves the right and power (and the same is hereby given them) to terminate, cancel or annul this contract for a violation of any or either of the conditions and stipulations herein set forth and contained, and for any other reason of cause which to said Philadelphia Base Ball Club may seem good and sufficient.
4th, And the said Philadelphia Base Ball Club shall and will pay the said Charles Mason as compensation for said services, &c., the sum of $700 (seven hundred dollars) divided into monthly equal parts and payable as follows: - Commencing June 1st 1876.
5th, That the said Mason during the month of April and May of the year 1876 does hereby agree that his services shall be an experiment and his play prove satisfactory to the manager and directors of said Philad B B C than the terms of this Contract to remain to remain in full force, otherwise to be null and void.
